So my art's been stolen and sold again.../update/

Journal Entry: Wed Aug 1, 2012, 9:03 AM

update: So....I contacted my relatives and my uncle is in the police force..he told me that unless I registered a copyright with the picture that was stolen before it was stolen, I would have a case in court. or else there would be nothing i could do and I would lose for sure if i tried to take it to court hahaha.....plus he said that this happens everywhere in China and if I didn't register a copyright to it in China, Chinese courts basically consider it public property and anyone would be able to use it....

:iconcryforeverplz:

well, plus i didn't even put a watermark on that artwork because it was for a contest and the contest rules didn't allow any sort of signatures......=_=;;;; "orz

tl;dr: there's nothing I can do so.....yup. ^^; I'm...actually just really sad more than anything else right now. v_v;;;. oh well. thanks anyways for your support, everyone...

:iconlazepoolplz:

Edit: aw, thanks so much guys for the support *sob*. I know there isn't actually much I can do at the moment. I do have relatives in China who may or may not help me. I won't know until I ask ^^; but i can't until tonight cause, well, day and night is exactly opposite from here. but anyways, thanks guys >A<;;~~

I know some of you guys told me that putting stuff on the internet will always have negative effects, and while I agree, I still want to share my art even at the cost of something like this : ). It might sound a little shallow, but sharing my art is a pretty important part to me as well as the drawing process itself. Actually, if I hadn't had this amount of watchers/favs/good stats on dA, my mom probably wouldn't have let me go into art, hahaha (not to show off, but i was pretty good at the violin and almost went pro...but i never liked it as much as I love art; but i've been forced to play the violin since i was 3 y/o ^^;).

That said, I'll see what I can do even if it looks really bleak right now hahaha "orz. Thanks again, guys ^^;

=====

...but this time, it's by a pretty big phone company in China. On the case. WTF. Am I to put big-ass watermarks on everything now? I don't even know what to do D;

website here: [link]

I only found out cause my dad was browsing around large companies to get a phone for my mom.

Dx Dx Dx wtffffffffffffffffffffffff i don't want to deal with this, fuck. Is this going to be an annual thing now? Cause from what i remember, the last time someone sold my work w/o my permission was also some time in july, just last year. ffffff "orz.

urgh, let me see if I can't work this out when I go back to China. I wanna sue their ass off, especially cause they're a pretty big company D:< but i don't even know where to start or have the money :iconcryforeverplz:.  plus the legal system is different in China so I don't even know omg fffffuck >A<;;!!

Out of curiousity, Is what they are doing Legal, I mean, was the piece copyrighted by Deviant art. I want to publish my novel on Da, but I am afraid that some ja is going to steel it and sell it as their own

I'm sorry to hear that.

You could write a letter asking them to either credit you in some way or remove the piece, and [though it may be more confusing] ask for payment, but I wouldn't know where it would go.

that's not right... with all the hard work your placed into creating your beautiful art none should have the right to just take and worst yet market them. I do hope that there is something that can be done for you and all those with a similar problem

Actually, you do have a form of copyright grounds, because if you go to the page of the deviation, underneath the title, where it says the category the deviation is in, to the right of that it will say, ©2012 *Qinni. And you are Qinni, therefore, you have a form of copyright even without the watermark.

You're in America, right?
In that case, wouldn't there be something about stealing something that wasn't on Chinese grounds, therefore making it an international theft?
dA copyrights your work the second you post it, unless I'm mistaken...

Since this artwork was for a contest she couldn't watermark it

But she posted it first, on US grounds, no?
And since it was stolen and marketed in China, wouldn't it be an international crime?

Sorry if I come out ignorant...I honestly don't know a thing about law.

It's all right, I know little about the law. But judging by their ignorance and stupidity on thinking they would actually get away with stealing from artists, it can be considered a crime
